Opening arguments in LoPorto ballot fraud retrial

Special prosecutor Trey Smith promised this new jury that he will prove that Michael LoPorto knew full-well that he was in possession of forged absentee ballots back in 2009 when Troy democrats tried to steal the nomination of the working families’ party on behalf of democratic candidates.

This time Smith is using power points on a screen and there will be far fewer witnesses than at the first trial, in part, because elections commissioner Edward McDonough’s case has been separated from LoPorto’s.

Also, in an effort to make a complicated case more simple for the jury, Smith will be using power point presentations.

Cheryl Coleman, LoPorto’s new defense attorney told jurors that the prosecutor's power points are not evidence. She said there is no evidence LoPorto knew the ballots were forged and she attacked the prosecution for allowing former city clerk William McInerney who admitted forging ballots for years to get ninety days of public service for his plea so McInerney can testify against LoPorto.
