ALBANY - Police arrested an Albany man Wednesday morning after a child pornography investigation.
46-year-old Jose Rodriguez was arrested at the scene without incident and charged with one count of possession of sexual performance by a child.
The investigation was done at 32 Ryckman Avenue, a private residence and site of a licensed daycare business.
"His wife is in the child care business," said Officer Steve Smith, Albany's public Safety Department Spokesman. "It's a private residence but they do run a licensed day care out of the residence. His wife and his mother and his daughter take part in that business but he has a different job."
Right now, there is no evidence that the daycare children were harmed, while the investigation is ongoing.
Rodriguez was arraigned Wednesday afternoon in the Albany City Criminal Court. Bail was set at $20,000.
The Office of Child and Family Services has been notified and they too will be conducting their own investigation.
