Accused child killer granted bail

GLENS FALLS - A judge has set bail for a Glens Falls man accused of manslaughter in the death of his 15-month-old son.

28-year-old Gary Waite is accused of killing his son, Jesse James Smith in February.

Police say he threw the child to the floor because he wouldn't stop crying.

Last month, the judge dismissed the murder count, finding Waite didn't act with 'depraved indifference.' 

Now, Waite is charged with manslaughter so Waite's attorney asked for bail to be set.

Judge John Hall set bail at $100,000 cash or $300,000 bond.
