UTICA - The trial of Timothy McGinn and David Smith is underway.
The two men from Albany are accused of misusing millions of dollars in funds they were supposed to be investing.
The Securities and Exchange Commission shut down their brokerage firm in 2009.
Several former employees of McGinn, Smith, and Company have already entered guilty pleas and are expected to testify for the government.
