A Gloversville ice cream truck driver is out of a job, after being accused of driving his truck, while drunk.

Phil Hollister of Mr. Ding-A-Ling was pulled over on County Highway 123 in his ice cream truck, shortly after midnight on Saturday.

The Fulton County Sheriff's Department says a patrol car saw him swerve into the other lane,

A sobriety test revealed a BAC of .15 percent.

Mr. Ding-A-Ling's owner says he will fire Hollister, and take back his truck.

Hollister is scheduled to appear in court next month.

You may remember Hollister from this past spring, when he accused the operators of competing ice cream truck Sno-Kone Joe, of harassing him and his business.

Hollister won the case.
