Police: Baby did not have skull fracture in assault case

ALBANY – A baby allegedly injured at the hands of an Albany police and fire dispatcher did not suffer a skull fracture after all. That’s according to Albany police.

Jason LaFountain was charged earlier this week with felony assault after police say he attacked his estranged wife and 10-month-old child.

Initially police said the child suffered a skull fracture. Friday they said the hospital made an error in reading the x-ray and the child did not have a skull fracture.

NewsChannel 13 called District Attorney David Soares' office to find out if this would have any impact on the case. His office refuses to comment because it's an active investigation.
