No appeal in NY casino lawsuit dismissal

A change of heart for the lawyer who challenged the wording of the casino gambling referendum in New York.

Eric Snyder now says he will not appeal a judge's dismissal of the lawsuit.

He had argued the proposition on the November 5 ballot was reworded to illegally advocate for a "yes" vote on Governor Cuomo's proposal for seven more casinos.

The judge never got to the crux of that issue, instead ending the case by ruling yesterday saying it was filed too late.

Snyder claimed the board changed the wording in secret.
