Democrat: Gay marriage, gov will fail

ALBANY, N.Y. (AP) - Combative Democratic Sen. Ruben Diaz Sr. says he thinks same-sex marriage won't gain final legislative approval and Gov. David Paterson just might cost Democrats their newly won majority.

Diaz, a minister strongly opposed to same-sex marriage, contends that the bill passed by the Assembly two weeks ago won't be approved in the Senate. Democrats will need at least one Republican to support the measure because they have just a 32-30 majority.

Senate Majority Leader Malcolm Smith is still trying to muster enough votes to pass it.

But Diaz also tells The Associated Press that if Paterson, who is leading the effort to legalize gay marriage, doesn't improve his record-low poll numbers he will likely cost Democrats the Senate majority in the 2010 elections.
