Prosecutors say Deana Olsen was under the influence of pot and the painkiller, codeine, when she crashed her SUV last August in Kingsbury.

48-year-old Terry Brownell was mowing her lawn when she was struck and killed.

Olsen's lawyer, however, tells our media partners the Post Star that Olsen was not high on drugs and was not using a cellphone.

They say her vehicle must have been hit by something, which caused it to lose control.
