New York's Highest Court is now trying to decide whether or not New York State inspectors should be held liable in the capsizing of the Ethan Allen Tour Boat.
Arguments were heard today in the New York State Court of Appeals.
The Ethan Allen capsized on Lake George in 2005, killing 20 people.
The boat was certified for 48 passengers, but federal authorities said later the limit should have been 14.
