ALBANY, N.Y. (AP) - State police say a state Supreme Court justice is facing a DWI charge following a traffic stop in suburban Albany.

Troopers say Justice Carl J. Landicino of Yorktown Heights was stopped about 4 p.m. Wednesday on Interstate-87 in the town of Colonie after he was spotted driving aggressively.

Police say Landicino failed field sobriety testing and refused to submit to a chemical test to determine his blood alcohol content.

He was charged with driving while intoxicated and traffic infractions, arraigned in the village of Menands and released with a scheduled court return Oct. 29.

A call to Landicino, a justice in Brooklyn who was elected last year, was not initially returned Thursday.
