Albany County Sheriffs are investigating a fatal accident in the Town of Westerlo involving one car striking a deer.

45 year old Timothy Webb of Greenville was traveling along County Route 408 at around 1:30am Sunday morning near Johnny Cake Road. He struck a deer, causing him to run off the road and collide with a tree. Webb was deceased when police arrived on scene. Investigators believe speed was a factor.

During the course of the investigation, a portion of Rt. 408 was shut down and road blocks were put in place. Just before 2:30am 26 year old Jeremy Lewis of Westerlo failed to stop at the barricade. When police pulled him over they smelled alcohol. Lewis failed a field sobriety test and had a blood alcohol content was .21%. Lewis was also found to have brass knuckles. He was arrested and charged with Aggravated DWI and Criminal Possession of a Weapon, both misdemeanors.
