Charges likely to be upgraded in deadly crash

RENSSELAER - There are new developments Thursday in the case of the Rensselaer police officer charged with drunk driving in connection with a fatal crash that happened Wednesday morning.

Rensselaer County District Attorney Richard McNally tells NewsChannel 13, that pending the results of lab reports there will likely be upgraded charges against 22-year-old officer Mark Fusco.

No word when those lab reports will come back.

Fusco remains hospitalized.  His father is Rensselaer police chief.

Fusco was driving Wednesday morning when his car slammed into a tree on the Third Avenue extension.

His passenger, 22-year-old Sean Murphy of Slingerlands, was killed.
