Attorneys for the Wandering Dago food truck have now filed a federal lawsuit, saying their client's constitutional rights have been violated.
The Wandering Dago food vendor specializes in homemade Italian street food.
It's name refers to Italian laborers that would be hired on a daily basis, 'as the day goes'.
It was banned from New York's summer outdoor lunch program and from the Saratoga Race Course, despite being an approved vendor there, because certain NYRA and state officials found the name to be offensive.
