New Yorkers will get to vote on a controversial casino referendum after all.
On Wednesday, a judge dismissed a lawsuit that challenged the wording of the ballot proposition.
That question was re-worded by the Cuomo administration and legislative leaders to promise benefits including jobs, lower taxes and school aid.
It mentioned no potential downside to casinos, including problem gambling and crime.
The state argued, the lawsuit was filed too late and a judge agreed.
The attorney who filed the suit plans to appeal.
