Man who escaped rape charges arrested for burglary

The Rensselaer man who escaped rape charges last month is now locked up in a separate case.

John Halacy, 24, started his day with a court appearance on less serious charges in connection with the rape case, but he was arrested moments later by Colonie Police on burglary charges.

Halacy is locked up at the Albany County Jail, but headed right back to court on Thursday morning to be arraigned on the burglary charges.

John Halacy stood before a judge in Rensselaer City Court on Wednesday morning, facing an attempted rape charge. That was just the beginning of a day filled with legal problems.

Soon after the case was adjourned, Colonie Police were waiting for Halacy. They put the cuffs on the him, charging him with burglary.

Police say he was one of three involved in a Thanksgiving Day break-in at a home on Haswell Road in Colonie.

“Once inside on Thanksgiving day they stole a variety of items, which include some electrical devices, computers video games, a large screen TV, and some guitars,” said Lt. Robert Winn, of Colonie Police Department.

Police say they developed information from the public and other sources that led them to Halacy's apartment on Second Street in Rensselaer.

“We did find some evidence that was stolen in the burglary at the house when we executed the search warrant both in the vehicle as well as the residence,” said Lt. Winn.

According to police, most of the stolen property has been recovered. That includes the guitars police say Halacy had already sold to a music store at Colonie Center.

Halacy's brother, Raymond Halacy and an associate, Andre Beverly, were also arrested Wednesday morning. U.S. Marshals picked them up in Florida.

“They were here living in this area. Shortly after the burglary, they went to the state of Florida,” said Lt. Winn.

They're locked up awaiting extradition to the Capital Region.

Meanwhile, Halacy's legal issues in Rensselaer are far from over. They stem from a rape case where the most serious charges against him were dropped last month on a technicality. The D.A.'s Office is looking at presenting the case to a grand jury.
