Recently released court documents outline some of the case against Jesse Sawyer of Troy.
They accuse him of producing child pornography involving girls 5, 3and 2 years old.
According to court papers, Sawyer admitted to the sexually explicit photos in a phone call with the children's mother, said he was sorry and that he needed to get help.
Sawyer also allegedly sent Facebook messages to her that said, "I know I need help this is not who I am I never wanted to hurt [the children]," and "I will make this right... u girls are my heart I am not that monster."
Sawyer appeared in federal court in Tampa, Florida.
"One of the reasons we chose to go federally is that the minimum sentence on a federal charge is 15 years," said Troy Police Capt. John Cooney. "That would have been very difficult to achieve through New York State penal law prosecution."
"First, he's going to have to appear before a federal judge where he was arrested on the northern district warrant. He was arrested in Florida. So you expect him to appear in front of a federal judge in Florida and arrangements will then be made for his transfer," said attorney Paul DerOhannesian, who is not involved in this case.
The accused child pornographer was captured Friday after an eventful two days. A national manhunt for him went on for more than a week. He was detained in Florida, then released because of a paperwork delay, only to surrender to police a few hours later.
"Jesse Sawyer in prison means that children are safe," said Cooney. "Whether it be through a New York State prosecution or a federal prosecution, the goal would be to get the maximum sentence possible and the federal charges will achieve that."
According to court documents, the girlfriend of Sawyer's father discovered the photos of the children on a laptop that she had let him use while he was living there.
Sawyer is expected to be brought up to New York State to be prosecuted.
