Troy man accused of killing child

TROY - The Troy man accused of killing his girlfriend's 3-year-old daughter was in court Monday morning.

Twenty-seven-year-old John Andrew Tinkler pleaded not guilty to charges of murder and endangering the welfare of a child.

Police say Tinkler was watching Zoey Sandercox at their Fourth Street apartment on Saturday when she stopped breathing. The little girl later died at a local hospital.

In a statement to police, Tinkler claims the girl fell in the bathtub and hit her head, but the autopsy says Sandercox was assaulted and died

"It's not uncommon for a defendant's statement to be at odds with what our theory is. That's more common than not. Mr. Tinkler has a presumption of innocence and we honor that and respect that," Detective Sgt. David Dean said.

Tinkler is being held at the Rensselaer County Jail without bail.
