AG works to beef up case against Rensselaer County DA

TROY - The Times Union is reporting that investigators seized Joel Abelove's county email account earlier this week.  The search warrant stems from District Attorney Abelove's handling of the Edson Thevenin case.  A Troy police officer shot and killed Thevenin during a traffic stop this month, last year.

The printed report indicates that the search warrant was issues Tuesday and required Rensselaer County to provide a digital copy of Abelove's emails to Attorney General Eric Schneiderman's investigators.  The County complied.

In March, the Da's cell phone was seized.

In response to the case, Abelove has filed a suit against New York State challenging the Governor's order that the Attorney General, and not local District Attorneys, probe police related shootings.

Abelove's attorney claims authorities won't find anything to help build their case and that the investigation has no merit.

"Of course he's under stress but I talk to him frequently and he's very focused on doing his job,  it's a tough job, being DA...he's able to put this where it belongs in terms of things he needs to worry about and focus on his primary responsibility," explains Abelove's defense attorney, John Bailey.

Bailey adds that it's his understanding that the Judge assigned to the case - not the Attorney General - will be the one going through the emails.
