Autobody shop owner out on bail pending assault conviction appeal

An appellate judge has signed an order staying John Cole's conviction and releasing him on $50,000 bail pending the appeal of his case.
On Friday, a Saratoga County jury found Cole guilty of assault and driving while ability impaired by alcohol. He was found not guilty of vehicular assault and DWI.
Cole was driving 78 miles per hour in a 40 mile per hour zone when he crashed his BMW into a tree, permanently injuring a backseat passenger.
Cole will be sentenced next month, but will remain free on bail until the outcome of his appeal.
