State Supreme Court dismisses DA's lawsuit over police-involved shooting

The New York State attorney general can move ahead with an investigation into how Rensselaer County's district attorney handled a police-involved shooting.

The State Supreme Court dismissed District Attorney Joel Abelove's lawsuit against the attorney general on Friday.

Abelove argued the attorney general did not have jurisdiction to investigate police involved deaths. The court disagreed.

The case involves the death of Edson Thevenin. He was shot and killed by a police officer during a traffic stop in April 2016.

Within a week of his death, Abelove presented the case to a grand jury that cleared the officer of any wrongdoing.
