BALLSTON SPA - Trooper Timothy Pratt's daughter received a disturbing phone call from a credit card company.  Someone had opened an account in her recently passed father's name and it happened on the very day the 55-year-old was being buried.

Steven Calderon pled guilty in July but Thursday learned his fate - 1 1/3 to 4 years that will be served concurrently with similar sentences downstate.

The man whose identity he stole was a 30-year veteran of the New York State Police. Trooper Timothy Pratt was killed by a passing car as he stopped to help a disabled tractor trailer near the Wilton barracks.

Trooper Pratt's daughter, Sarah Pratt, gave the victim impact statement and told the court that it was important to her that Calderon "...see the face of a person he hurt," and later "...his actions cause pain to people already suffering."

At the sentencing Calderon said very little but did apologize and send condolences to the entire Pratt family.
