Wilfredo Diaz sentenced to 50 years to life

SARATOGA - One thing Wilfredo Diaz's victim wants him and everyone else to know, is that she is not a victim.

She called herself a survivor and spoke for about eight minutes directly to Diaz, calling him "Freddy."

In the woman's statement, she said it was her strength to speak out that was rewarded with taking away any hope Diaz had for a happy future.

After she finished speaking, Judge James Murphy announced that on counts 1 and 4 of predatory sexual assault, Diaz will serve 25 years to life on each count that will run consecutively, one after another.

Once the judge concluded, it was unclear what Diaz's attorney said to him but he could be seen smiling and laughing, seemingly unaffected by the sentencing. 

"The biggest mistake you made that night was to underestimate me. You underestimated my determination to fight back and my will to live. You underestimated my strength to stand up and speak and do the second hardest thing I have done since the night you violated me and my body."

We disguised the woman's voice to protect her identity.

She went on to say that where Diaz is going, they don't like rapists, especially those who have hurt children, referring to a prior rape that Diaz was acquitted of.

Two more counts of sexual abuse and assault in the second degree carry a 7 year sentence but Judge Murphy said those will run concurrent with the 50 year sentence.

For failing to register as a sex offender, Diaz received an additional one and a third to four years in prison.
