Health and fitness clubs are not part of that next Phase 4 as originally planned. So when will they be allowed to reopen? How long can gym owners wait before irreparable harm is done to their bottom line?

Are all fitness clubs playing by the rules? There is evidence that maybe they're not.

After NewsChannel 13 received email messages about HealthPlex Fitness in Halfmoon, we came to check it out for ourselves.

NewsChannel 13 observed people going in and out wearing workout clothes.
We spotted people at the exercise machines.

A parent contacted NewsChannel 13's Dan Levy concerned about her child going to the HealthPlex with friends to work out and then coming home.

HealthPlex owner Steve Burke told NewsChannel 13 he's doing nothing wrong. His fitness center is closed and it's been closed since March.

He says people enter and leave his building all day long because there are several other essential businesses inside, including a podiatrist's office and physical therapy.

County Executive Dan McCoy says the only people who should be going in and out of fitness clubs for now are the owner and the people who clean the place.

McCoy says he's awaiting guidance from the state before he allows gyms to reopen.

Hear from Albany County's health commissioner about some concerns with re-opening gyms too soon by watching the video of the story.
