Judge denies development of new Guilderland Costco and Rapp Rd. apartments

GUILDERLAND- An Albany Court Judge rules the challenged approvals of a future Costco near Crossgates Mall and the development of more than 200 apartments on nearby Rapp Road “arbitrary and capricious, null and void.”

Save the Pine Bush and the Guilderland Coalition for Responsible Growth says they’re pleased to announce this court victory against the Guilderland Planning Board.

NewsChannel 13 received the 77-page court document Saturday morning. Part of which says, according to Judge Peter Lynch, not only did the planning board fail to require a viewshed analysis, it wasn’t even mentioned in several key areas.

Also adding, plans “violated SEQRA procedure and the hard look test.”

NewsChannel 13 reached out to Guilderland Town Supervisor Peter Barber and will provide any new details as they become available.
