Cohoes residents have filed a lawsuit against Norlite and its parent company over hazardous dust they say comes from the plant.
They claim hazardous silica dust emissions are coming from the facility.
They also believe that dust contains harmful glass particles known to cause silicosis and various other ailments.
They also claim the dust is affecting people's property, and other damages.
The New York State Department of Environmental Conservation released its report earlier this month. The report found no link between PFAS contamination near the plant and the burning of foam. Environmentalists say the DEC's report is misleading.
