There was a major development on Tuesday in the St. Clare's pension saga.

A group of 126 pensioners filed a lawsuit against the diocese, Bishops Hubbard and Scharfenberger, St. Clare's and the board.

As you'll recall, former workers at the now defunct hospital were told back in October that their pension fund was gone.

Last week, NewsChannel 13 found out through the attorney general that the board approved buying liability insurance years ago, but never pulled the trigger.

NewsChannel 13 reached out to the Diocese of Albany on Tuesday. They tell us they don't have any comment on the suit right now, but maintain they never managed the fund. Lawyers for the pensioners say they want to prove that's not true.

The lawsuit does not lay out a specific amount of money for damages. They are asking the number be determined after a jury trial.
