Special prosecutor assigned to Kolb DWI case

A special prosecutor has now been assigned to handle the DWI case against state Assembly Minority Leader Brian Kolb. The case will be prosecuted by the Yates County district attorney.

Police arrested Kolb around 10:30 p.m. on New Year’s Eve. They say Kolb drove his state-issued SUV into a ditch near his home in Ontario County.


Kolb failed several field sobriety tests, and police say his BAC was above 0.08 percent. He was charged with DWI and making an unsafe turn.

"There is no excuse and no justification for what occurred Tuesday evening," Kolb said in a statement. "I made the wrong decision, and it is one I deeply regret."

NewsChannel 13 is working to learn how badly the SUV was damaged, and who will be paying for repairs if they’re needed.
