Bail denied for Saratoga County man accused of shooting girlfriend

BALLSTON SPA - Stephen Lerario didn't say anything about what happened inside his girlfriend's Greenfield home earlier this month.

The 42-year-old is accused of firing a shotgun at his girlfriend, Katie Gilbert.

Gilbert somehow survived the April 7 attack, but prosecutors said today in court that she lost her right eye and suffered numerous facial fractures.

Lerario and Gilbert have a young child in common. The district attorney isn't saying what led to the shooting.

"Had an issue between each other that escalated well beyond what should happen in any case between two people," said Saratoga County District Attorney Karen Heggen.

Lerario has a long criminal history---felony convictions for drug sales and weapons possessions. Most of the crimes occurring downstate, which didn't help his case as he asked for bail to be set Monday.

Judge Jim Murphy finding that Lerario has no significant ties to the community and sent him back to jail.

Prosecutors say if Lerario is convicted, he could be sentenced to up to life in prison as a persistent felon.

Heggen said there's a possibility the first degree assault charge could be upgraded to attempted murder.

"We're going to thoroughly go through everything and make a determination based upon the evidence as to what will be presented to a grand jury and let a grand jury make a final determination."
