Albany Police Officer Christofer Kitto has been suspended without pay.
Kitto was involved in a fatal shooting on Monday in Utica while off-duty.
Kitto says the man he shot and killed was trying to rob him.
The Oneida County District Attorney says it appears it was self-defense, but his investigation isn't over.
Kitto was charged with patronizing a prostitute.
