Court of Appeals won't hear case of businessman who paralyzed friend

The state Court of Appeals says it will not hear John Cole's case.

The Clifton Park businessman was making a last-ditch effort to stay out of prison.


Cole's conviction was upheld last week by an appellate division of the state Supreme Court.

A jury found Cole guilty of assault, driving recklessly and under the influence when he caused a crash in March of 2017. It left his friend and passenger, Deanna Shapiro, a quadriplegic.

Cole is supposed to begin serving a seven-year sentence on Wednesday.
