Man accusing off-duty Troy cop of hurting him intends to sue

TROY - The man who says he was elbowed by an off-duty Troy police officer at a local little league field now intends to sue the city of Troy.

Darren Ayotte held a news conference Monday with his attorney, Lee Kindlon. They shared police dash cam video from September 8, the day Dominick Comitale was arrested in North Greenbush.

Ayotte says Comitale can be heard on the tape talking about payback. He says he wants him fired from the force.

Ayotte says he wants an order of protection, but so far one hasn't been granted.
