ALBANY - A man nearly beaten to death is recovering in the hospital. Albany police say it happened near the corner of Lexington and Central just before 3 p.m. Saturday afternoon.

Hubert Dabbs, 37, is locked up, charged with attempted murder as a hate crime. Police believe Dabbs attacked the victim because he is gay.

NewsChannel 13 is told the victim's injuries are now considered to be non-life threatening. His identity will not be released by police.

Steve Smith with Albany Police says witnesses told them Dabbs was stomping on the victim's head repeatedly. A bloody footprint was left behind on the steps of the apartment building where the victim was found in the doorway.

Smith says the victim had serious injuries to his face and head, including fractures and lacerations. They say he was unconscious when they arrived on scene.

Smith says due to help from bystanders, they were able to take Dabbs into custody right at the scene. He was arraigned Tuesday morning and is now in Albany County Jail.

Smith says they believe Dabbs and the victim knew one another and that some sort of argument broke out just before the beating started.

Smith said police have dealt with Dabbs in the past, specifically with other instances of assault. I asked Smith if any witnesses stepped in to stop Dabbs from stomping on the victim's head and face. He said he wasn't sure, but he did say a bystander called police right away, so they were able to get to the scene to get the victim to Albany Medical Center and then take Dabbs into custody shortly after.
