Cole, convicted of assault, wants to take case to NY's highest court

The Clifton Park businessman who lost his appeal of an assault case that left his friend paralyzed is making a last-ditch effort to stay out of prison.

John Cole's conviction was upheld last week by the Appellate Division of state Supreme Court.


Cole is now trying to get his case heard by the highest court in the state, the Court of Appeals. His attorney has asked for the court to take immediate action because Cole is supposed to be taken into custody Wednesday to begin serving a seven-year sentence.

A jury found him guilty of assault, driving recklessly and under the influence when he caused the March 2017 crash that left Deanna Shapiro a quadriplegic.
