Closing arguments expected in DWI trial of prominent autobody shop owner

We expect to hear closing arguments Thursday in the trial of John Cole. He's the local business owner charged with driving while intoxicated and causing an accident that left a friend critically injured.

The defense rested early Wednesday evening.


Cole is the owner of several Cole's Collision Center auto body shops. He is facing up to seven years in state prison.

Police say he was driving drunk and speeding his BMW at 78 miles per hour last March, when he lost control on Sitterly Road and crashed. The crash left his backseat passenger, Deanna Shapiro, a quadriplegic.

Blood evidence was not allowed due to errors in processing, so there's no scientific evidence to prove Cole was drunk. That means jurors will have to decide who to believe – the New York State Police reconstruction experts or the defense.
