The former Prattsville town supervisor and a businessman are charged with fraud related to Tropical Storm Irene.
The indictment unsealed Friday involves former Supervisor Kory O'Hara and Stephen Baker.
Investigators say they cooked up a plan to fraudulently obtain grant funds following the storm.
The Department of Justice says Baker gave O'Hara false invoices from his modular home business, claiming to do construction work on O'Hara's garage.
They say Baker never did the work but O'Hara cut him checks, and then Baker gave back the money.
Investigators say O'Hara then submitted false invoices to get thousands in grant money.
