The woman convicted of failing to report she struck and killed a man who was walking along Route 9 in Halfmoon is preparing for a new trial. An appeals judge ruled it must take place in Saratoga County.
Maria Lentini was convicted of failing to notify emergency services that she hit and killed Patrick Duff. However, she appealed and the higher court ruled Lentini could have a new trial because jurors shouldn't have been allowed to hear testimony that she refused to answer questions until she spoke with an attorney.
Lentini's attorney wanted the case moved out of Saratoga County, arguing publicity would make it impossible to get a fair trial.
An appeals court denied that motion and Lentini's re-trial is scheduled to begin January 7 in Saratoga County.
