A murder trial is now underway in Albany County. Thomas Slivienski is accused of killing a teenager last year on a bike path in Cohoes.
During the opening arguments on Thursday, the assistant district attorney acknowledged there were no eyewitnesses in this case, the defendant didn't leave any of his DNA at the scene, and the murder weapon has never been found. However, prosecutors still remain confident they will win a conviction against Slivienski.
The 23-year-old defendant sat stoically in the courtroom, listening intently as the assistant district attorney told jurors that Slivienski texted 17-year-old Johni Dunia the evening of November 16, 2018, setting up a 10 p.m. meeting with him at the Cohoes bike path and asking him to come alone.
Four of Dunia's friends waited for him nearby as Dunia went to meet his killer.
There were five gunshots that night. The final two were fired into the back of Dunia's head.
The district attorney says he expects to call up to 40 witnesses over the course of the next couple of weeks.
Hear what prosecutors say the motive was – and why the defense attorney says it just doesn't add up, by watching the video of Dan Levy's story.
