D.A. gets new indictment in Mechanicville murder

Two Saratoga County men already indicted on murder charges were indicted again late Thursday afternoon.

The new formal accusation follows a problem earlier this week in the case against Nikolai Mavashev and Joseph Broscko, who are both charged in the August shooting death of David Feliciano at Feliciano’s Mechanicville home.

On Tuesday, Judge Jim Murphy told prosecutors and defense attorneys that his review of grand jury minutes found “irregularities” in the way the Saratoga County District Attorney’s Office presented the case to a grand jury in September.

The law requires grand jury proceedings to be secret so what exactly went wrong isn’t being disclosed, but Murphy appeared ready to dismiss the indictment next Monday.

However, when Saratoga County District Attorney Karen Heggen learned of the legal errors, she presented the evidence to a new grand jury Wednesday and Thursday and a new indictment was handed up to the judge late Thursday afternoon as NewsChannel 13’s camera was rolling.

The new 28-count indictment includes charges of murder in the first degree for Mavashev, who is 19, and second-degree murder for Broscko, who is 17.

The young men are being held in the Saratoga County Jail. They’ll be arraigned Monday, Nov. 20.
