Cohoes man pleads guilty to criminally negligent homicide in death of friend

BALLSTON SPA - Samuel Heroux pleaded guilty Tuesday afternoon to criminally negligent homicide for an August 2017 incident that left a friend dead.

Heroux was 20 at the time. He and a 17-year-old friend drove Liam McGlinchey from Cohoes to McGlinchey's grandmother's home in Clifton Park and left McGlinchey on the front lawn.

They knew the 19-year-old who'd moved here recently from Ireland was highly intoxicated and couldn't walk.

When Judge Jim Murphy asked Heroux to admit what he did, he exchanged whispers with his attorney and then said, "Through the action of negligence, I uh, Liam passed away."

Heroux also admitted in court that he and his friend drove away and came back to see McGlinchey in distress but didn't call for help, or try to help him inside.

Assistant District Attorney Bobby Logan questioned Heroux in court: "Did you observe some type of mucous or some other type of substance on his face and nose?
Heroux: "Yes. Saliva."

Logan continued, "These actions or your failure to take actions represent the failure to perceive the risk of death to Liam McGlinchey, correct?"
Heroux: "Yes."

The judge scheduled sentencing for August 8 when McGlinchey's family can attend from Ireland. He's expected to get six months in jail followed by five years probation.

District Attorney Karen Heggen calls the case a tragedy and says she hopes young people are paying attention.

"The choices and decisions that they make can bring about tragic consequences and this is an example of that. We hope that bringing this forward does in fact ring a bell to those young people who are heading into graduation time."

The other young man involved is not being publicly identified by police and prosecutors because he was underage at the time, but he also pleaded guilty to criminally negligent homicide.
