Judge: Schoharie D.A. can give grand jury subpoenaed material to defense team, with limits

The judge in the deadly Schoharie limo crash case will allow the district attorney to disclose grand jury subpoenaed material received by Mavis Discount Tire to the defense team representing Nauman Hussain. However, the court says the defense can't distribute any of those records or videos to any third party not part of the defense team without an additional court order. 

The prosecution told the court they believed the materials were potentially exculpatory, which means evidence may exist that could clear Hussain of wrongdoing.


He's the operator of the limo company involved in the crash that killed 20 people nearly one year ago and already pleaded not guilty to manslaughter and criminally negligent homicide charges.

Meantime, NewsChannel 13 is still waiting on new safety guidelines protecting passengers from the NTSB before the one-year anniversary next month.

The trial is set to start January 6.
