GLOVERSVILLE -- Gloversville Mayor Dayton King pleading not guilty to a charge of official misconduct Wednesday evening.
Outside of Johnstown Court following King’s arraignment, his attorney, Bob Abdella, predicted a victory for him.
“And ultimately pretty darn confident that we're going to be able to come out of this with an acquittal,” Abdella said. “And the mayor being fully exonerated.”
State police accused King of using his authority to look in the personnel file of Gloversville firefighter William Rowback as the two ran against each other for mayor.
The charge has some Gloversville residents calling for King’s resignation.
Rowback is not going that far just yet.
“I'm leaving it up to the DA and the judge to make their decision,” Rowback said.
Police said mayor King disclosed information from Rowback's file during a local radio debate between the then-opponents.
In a recent Facebook post, King put the blame on Rowback.
“He repeatedly pressures me on live air to discuss information contained in his personnel file,” King said in the post.
“He was in my files before the radio talk show so that's illegal,” Rowback said.
During the October 28th radio debate, the pair discussed the fact that Rowback was not promoted to become a fire investigator.
At one point, King shot back at Rowback for calling in sick and not getting along with others.
Rowback was initially declared the winner of November's election until the board of elections noticed an error in vote counting and later declared King the winner.
However, Rowback said he is willing to bury the sour feelings with King.
“I am a child of the most high God,” Rowback said. “If King was to work through this parking lot right now I go over and shake his hand.”
Rowback said his future political plans are up in the air.
“If the court makes him to resign that means I'll be running for mayor next November,” he said.
