GLENS FALLS - According to a federal indictment, 29-year old James Bonet of Glens Falls posted a picture of himself on Facebook smoking what appears to be a marijuana cigarette inside the U.S. Capitol during the January 6 riot.

An additional video from Bonet's screen was recorded inside the Cyrpt of the Capitol where Bonet can be heard responding to the chant, "Whose house? Our House!" a few times.

On yet another video, it is alleged Bonet is overheard saying, "We made it in the building, and we're taking it back."

After Bonet's co-workers in Saratoga Springs saw those videos, they're the ones who contacted the FBI. And when interviewed by agents, those co-workers told them Bonet had been promoting conspiracy theories at work that the 2020 presidential election was stolen.

Bonet has been charged with knowingly entering or remaining in a restricted building or grounds without lawful authority, and disorderly conduct on Capitol grounds.

NewsChannel 13's media partners at The Post-Star Newspaper are reporting that Bonet contacted them Tuesday night and admitted he was in the building, but insisted he did nothing wrong.

He told the Post Star the "cops let him in" and he didn't damage any property. He also told them he was smoking a regular cigarette, and claims he was "practicing his first amendment right to peacefully protest."
