Man sentenced for rape, criminal sex acts, and threatening victim with a weapon

The Albany County District Attorney says that a 32-year-old man was sentenced Tuesday afternoon to 40 years in state prison and 25 years of post-release supervision after being convicted of rape, a criminal sexual act, and criminal possession of a weapon.

The sentencing follows the December 1, 2022 conviction of Germaine Montes for those charges.

The indictment alleges that Montes had forcible sexual contact with a victim on February 14th, 2021, on Washington Avenue in Albany.

The DA’s office says that he threatened the victim with a gun in order to get them to perform sex acts.

They also say that the next day Montes was found to be in possession of a loaded, illegal, and operable firearm.

In addition to his prison sentence Montes will be required to register as a sex offender, and a no-contact order of protection has been issued on behalf of the victim.
