The man from Moreau who shot and paralyzed his neighbor back in 2017 wants his conviction overturned.
Joey Castro was found guilty in 2018 and was sentenced to up to 46 years in prison.
Castro’s attorney told a state Appellate Court on Monday afternoon that the county judge should have allowed him to pursue a psychiatric defense, because his client was under the influence of alcohol and prescription drugs for anxiety at the time of the shooting.
The attorney for the people argued that the judge’s ruling was appropriate because Castro’s medications were legally prescribed, and he was aware of any possible side effects.
