Judge in Klein case rules on key evidence as ill juror cuts testimony short Monday

The beginning of the third week of the Jacob Klein trial was over before testimony started on Monday.

A juror was ill in the hospital over the weekend. They have since been released, and advised the court that the soonest they could make it in was on Tuesday.

There are four alternates on the jury, and prosecutors had asked to proceed with one of them, but a decision was ultimately made to wait and see what happens on Tuesday.

Klein is accused of killing Philip Rabadi in his New Scotland home in April 2022. He had been in a relationship with Klein’s wife many years ago, before she married Rabadi.

Klein is acting as his own lawyer in the trial, and denies responsibility.

Meanwhile, Judge William Little ruled that a witness from the New York State Intelligence Center can testify to a map of data from Klein’s phone.

Klein had objected to testimony about his phone’s location in relation to cell towers, arguing data could contain errors and does not account for elevation and other factors.

Prosecutors argued the map was simply a representation of cell data already in evidence, and Little ruled in their favor.

Later this week, jurors could see testimony from Rabadi’s wife, Elana Radin– Klein’s ex-girlfriend they say he was targeting when he allegedly killed her new husband.
