The husband of a man accused of killing a six-week-old baby appeared in court on Thursday. The couple was caught in January after two years on the run.

Neil Garzon was arraigned in Cohoes City Court on a charge of hindering prosecution.

Garzon and his husband, Anthony Ojeda, were wanted in connection with the death of Baby Eli in December 2019.

Ojeda, Eli’s guardian, was charged in June 2021 with second-degree murder, manslaughter and endangering the welfare of a child. Garzon had been charged with endangering the welfare of a child. The couple were released on conditions and then fled the area.

A not guilty plea was entered for Garzon. He is also facing charges in Albany County Court related to absconding.

Cohoes Police Chief Todd Waldin said is a “relief” that the two suspects were finally captured. The case has been a “roller coaster ride.”

“You have a lot of ups and downs. You have the thought that we’ll be able to catch them, that maybe they didn’t get outside of New York, or maybe they got a few states away,” he said. “And the reality of the fact that they’re actually outside the country, and all the work that has to go into bringing them back again.”

The U.S. Marshals Service offered a $25,000 reward for their capture and made this case a priority.

“Luckily for us, the U.S. Marshals Service thought this was important enough that they not only adopted the case but put them on the Top 15 Most Wanted and that opened up a whole lot more resources and made it much more practical for these two to be caught,” he said.  

Ojeda is still in Mexico City awaiting extradition.
