Man guilty of sex with victim who could not consent

An Albany man has been convicted of having sex with victim who could not consent because of a mental disability.

A former Albany man has been found guilty of having sex with a person who could not consent.
The incident took place on or about Nov. 30, 2020 on Morris Street.

Carl Barton, 58, was convicted of second-degree criminal sex act and second-degree sexual abuse. Barton had sex with a person who was not capable of consent due to a mental disability, according to the Albany County District Attorney’s Office.

Sentencing is scheduled for May 31.
