Appeal in infant’s death to be heard by Massachusetts’ highest court

Massachusetts’ highest court will hear an appeal in the case of an infant who died in foster care, in Berkshire County.

Matthew Tucker and Cassandra Barlow-Tucker had been caring for the baby, when he was found dead in his crib, in 2020, NewsChannel 13’s media partners at The Berkshire Eagle report.

The couple was charged with manslaughter.

However, the case was dismissed by a Berkshire Superior Court judge, who ruled there was insufficient evidence to support the charges.

Berkshire County District Attorney Timothy Shugrue has recused himself from handling the case.

Shugrue, while a practicing defense attorney, consulted with the couple when the case was still in its early stages, reported the Eagle.
