FIRST ON 13: District attorney says the word ‘victim’ should not be banned in Gillis trial

The Washington County District Attorney’s Office is responding to that motion from accused murderer Kevin Monahan to prevent the use of the word “victim” when referring to Kaylin Gillis.

The Washington County District Attorney’s Office is responding to that motion from accused murderer Kevin Monahan to prevent the use of the word “victim” when referring to Kaylin Gillis.

In a response filed late Friday afternoon, the DA said the defense in their own motion said Monahan “accidentally shot and killed” Kaylin Gillis when she rode in an SUV that mistakenly turned around in his driveway in Hebron in April. That, according to the DA’s filing, makes Gillis a victim.

Prosecutors wrote that it will be readily apparent to the jury that the prosecution’s theory of the case is that Kaylin Gillis is a murder victim and Kevin Monahan is the murderer.

Monahan’s attorneys also want the judge to preclude the use of the words “perpetrator” and “assailant” when referring to Monahan.

Judge Adam Michelini is expected to rule on all of this next week. The jury trial is scheduled to begin Jan. 8.
